In a system of concessions, the public tenders are the decisive moments. The outcome of the public tender sets the stage for the development of the gaming industry for potentially very long periods.
In 2022 public tenders were held in both Macau and Portugal (gaming zones of Estoril and Figueira da Foz) for awarding concessions of games of chance.
While the underlying administrative law concept of a gaming concession is essentially the same in both jurisdictions, the way the public tenders were organized and decided in each one is remarkably different.
The paper provides a broad overview of the development and outcome of the 2022 public tenders held in both jurisdictions. A critical analysis of the regulatory goals and policy priorities adopted in each jurisdiction is made, in the light of the economic and social contexts.

The broader interest and implication of this discussion is to contribute to a clarification of the basic question of whether the concept of an administrative law concession for games of chance is still pertinent or relevant in the 21st century.
